Welcome to Akkipet. These Terms of Use ("Terms") govern your access to and use of the Akkipet platform, including our website at akkipet.in, the Aggrow mobile application, and all related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, browsing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Platform.

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or Platform notification.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years old or the age of legal majority in your jurisdiction
  • Have the legal authority to enter into binding contracts
  • If registering on behalf of a business entity, have the authority to bind that entity to these Terms
  • Not be a person barred from receiving services under the laws of India or any other applicable jurisdiction

Akkipet reserves the right to refuse service, terminate accounts, or cancel orders at its discretion if these conditions are not met.

3. Account Registration

To access certain features of the Platform, you must register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your login credentials confidential and secure
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account
Business Verification: Sellers on the Platform may be required to submit business registration documents, quality certifications, and other verification materials. Akkipet reserves the right to reject or suspend accounts that do not pass our verification process.

4. Marketplace Terms

4.1 Role of Akkipet

Akkipet operates as a marketplace that connects buyers and sellers of agri-commodities. Unless explicitly stated otherwise, Akkipet is not a party to the transactions between buyers and sellers. We facilitate the transaction by providing the Platform, quality certification, logistics coordination, and payment processing services.

4.2 Listings

Sellers are responsible for ensuring that their product listings are accurate, including descriptions, images, pricing, available quantities, and quality specifications. Misleading or fraudulent listings are strictly prohibited and may result in immediate account termination.

4.3 Pricing

All prices displayed on the Platform are in the currency indicated and are subject to change without prior notice until an order is confirmed. Prices may be quoted on CIF (Cost, Insurance, and Freight) or FOB (Free on Board) basis for international orders. The applicable pricing terms will be clearly stated at the time of order.

5. Orders & Payments

5.1 Order Placement

Placing an order on the Platform constitutes an offer to purchase. An order is confirmed only when accepted by the seller and acknowledged by Akkipet. We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, pricing errors, or suspected fraud.

5.2 Payment Terms

  • A minimum advance payment of 10% of the order value is required at the time of order confirmation
  • The remaining balance must be settled before shipment unless credit terms have been pre-approved
  • Payments can be made via bank transfer, letter of credit, or other methods supported on the Platform
  • All payments are processed through our secure payment infrastructure

5.3 Credit Lines & Factoring

Akkipet may offer credit lines or factoring services to qualified buyers, subject to separate credit agreements and approval processes. Credit terms, if extended, are at the sole discretion of Akkipet and may be modified or revoked at any time.

6. Quality Certification

Akkipet employs product experts who inspect and certify commodities listed on the Platform. While we strive for accuracy in our quality assessments:

  • Certification is based on representative samples and standard testing methods
  • Actual product quality may have minor variations within acceptable industry tolerances
  • Buyers should conduct their own inspection upon receipt of goods
  • Quality disputes must be raised within 48 hours of delivery, accompanied by photographic evidence and, if applicable, independent lab results

7. Shipping & Delivery

7.1 Fulfillment Options

The Platform offers multiple fulfillment methods:

  • Container Ready-to-Go: Pre-scheduled port deliveries with full container loads
  • Just-in-Time: 48-hour delivery from warehouse inventory
  • Route Sale: Truck-based regional delivery with split delivery options
  • Custom Fulfillment: Tailored logistics based on buyer requirements

7.2 Delivery Timelines

Estimated delivery timelines are provided in good faith but are not guaranteed. Akkipet is not liable for delays caused by force majeure events, customs clearance, port congestion, weather conditions, or other factors beyond our reasonable control.

7.3 Risk of Loss

For FOB shipments, risk passes to the buyer once goods are loaded at the port of origin. For CIF shipments, risk passes upon delivery at the destination port. For domestic deliveries, risk passes upon delivery to the specified address.

8. Intellectual Property

All content on the Platform — including but not limited to text, graphics, logos, icons, images, data compilations, software, and the overall design — is the property of Akkipet or its licensors and is protected by intellectual property laws.

You may not:

  • Copy, reproduce, or distribute Platform content without written permission
  • Use Akkipet's trademarks, logos, or branding without authorization
  • Scrape, crawl, or use automated tools to extract data from the Platform
  • Reverse engineer, decompile, or disassemble any Platform software

9. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws
  • Post false, inaccurate, or misleading product information
  • Manipulate prices, ratings, or reviews
  • Circumvent or attempt to circumvent the Platform's transaction process
  • Interfere with or disrupt the Platform's infrastructure or security measures
  • Engage in money laundering, fraud, or any other financial crime
  • Harvest or collect information about other users without consent
  • Use the Platform to trade in prohibited, sanctioned, or illegal commodities

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Akkipet provides the Platform on an "as is" and "as available" basis without warranties of any kind, whether express or implied
  • Akkipet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
  • Akkipet's total aggregate liability for any claims arising from or relating to these Terms or the Platform shall not exceed the fees paid by you to Akkipet in the twelve (12) months preceding the claim
  • Akkipet does not guarantee uninterrupted, error-free, or secure access to the Platform

11. Indemnification

You agree to indemnify, defend, and hold harmless Akkipet, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:

  • Your use of or access to the Platform
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any content or products you list, sell, or purchase through the Platform

12. Dispute Resolution

12.1 Between Buyers and Sellers

In the event of a dispute between a buyer and seller, both parties agree to first attempt to resolve the matter through Akkipet's internal dispute resolution process. If the dispute cannot be resolved through this process within 30 days, either party may pursue other legal remedies.

12.2 With Akkipet

Any disputes arising from these Terms or your use of the Platform shall be governed by the laws of India. The parties agree to submit to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India. Before initiating legal proceedings, the parties agree to attempt mediation in good faith.

13. Termination

Akkipet may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

  • Violation of these Terms or any Platform policies
  • Fraudulent, abusive, or illegal activity
  • Extended inactivity
  • Request by law enforcement or government agencies

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property, limitation of liability, indemnification, and dispute resolution sections.

14. Changes to These Terms

Akkipet reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Material changes will be communicated to registered users via email or prominent Platform notification at least 15 days before taking effect. Your continued use of the Platform after changes are posted constitutes your acceptance of the modified Terms.
